What is a fire risk assessment?
This is a legal requirement under the Regulatory Reform Fire Safety Order 2005. If you have five or more people in the premises, it is a written assessment identifying hazards, risks, how to reduce them and your plan of action if a fire were to occur. It must also be regularly reviewed and updated to ensure you conform to the law.
Regularly studying your assessment can range from reviewing your policy to ensure no changes within the premises (e.g. moving a desk or equipment) have increased the chance of a hazard through to checking your fire fighting equipment is working correctly.
Who can carry out a fire risk assessment?
In order to comply with legislation, it must be undertaken by a ‘Competent Person’. These are defined as individuals with sufficient knowledge, training and experience.
Who enforces fire safety?
It is enforced at a local level by fire and rescue authorities across the country. They visit premises to check whether or not risk assessments have been carried out and whether fire prevention measures are in-place and appropriate.
Your local fire and rescue authority have the power to recommend or enforce fire safety measures. This could be in the form of an informal suggestion or a written notice describing the issue and when it must be fixed by. Failing to adhere to this could result in a fine or closure of a premise.
What happens if I do not have a fire risk assessment?
In a worst-case scenario, you could face an unlimited fine and up to two years in prison if you are found guilty of breaking fire safety regulations. You may be fined up to £5,000 for minor infractions, but you are likely to be told about these beforehand and have a chance to rectify them. If you fail to do so, then a fine is likely.
